A couple accused funeral homes in Philadelphia and Georgia of inadvertently sending them their deceased son’s brain.Lawrence and Abbey Butler filed a lawsuit against Nix & Nix Funeral Homes in Philadelphia, Pennsylvania, as well as Southern Cremations & Funerals in Georgia.According to the lawsuit, the couple’s son, Timothy Garlington, died back on Nov. 15, 2023. He was 56-years-old, according to his parents. While Garlington was from Philadelphia, he lived in Georgia at the time of his death. The Butlers said they hired Southern Cremations & Funerals as well as Nix & Nix Funeral Homes to handle their son’s funeral arrangements.The lawsuit claims Southern Cremations & Funerals in Georgia transported Garlington’s body to Nix & Nix Funeral Homes in Philadelphia on Nov. 20, 2023. When the Butlers received their son’s personal items, they noticed a white, unmarked box, according to the lawsuit. The couple said they noticed something inside the box began to smell and leak fluid in their car. The lawsuit accuses the funeral homes of negligence in their handling of human remains as well as intentional infliction of emotional distress.The Butlers are represented by attorneys L. I just, again, as our attorney said, we just pray that this doesn’t ever happen to anyone else again. And it’s just, I had to get rid of that car. I just couldn’t stand the idea that the remains was in that car.”Stewart told reporters that his clients have not received an apology or an explanation from either funeral home. “To this day they don’t know if their son’s remains that were in the box were buried with the body,” Stewart said. “They have no earthly idea what happened.” You can view the lawsuit here or in the document embedded below.The owner of Nix & Nix Funeral Home told NBC Philadelphia his team did not know any brain matter was inside the box. He said his team believed the box held personal effects and they did not open the box to see what was inside. NBC Philadelphia reached out to the Pennsylvania State Board of Funeral Directors to learn more about any investigations into the matter. A spokesperson for the Pennsylvania Department of State said they cannot confirm or deny whether any licensee is under investigation or has been under investigation. The owner also said his team is working with their lawyer to discuss next steps. In a search of Pennsylvania’s Department of State’s website, NBC10 did not find any disciplinary actions published for Nix and Nix Funeral Home. The man who authorities believe fatally shot two Idaho firefighters before killing himself had once tried to enter the military and left a note addressed to his father in which he wrote he would “go into battle,” the Kootenai County sheriff said Tuesday.Wess Roley, 20, set a brush fire on Canfield Mountain near Coeur D’Alene on June 29 and then opened fire on responding firefighters, authorities said, in what they have described as an ambush. He later killed himself.Roley had tried to enter the U.S. Army in Arizona in 2023 and again in Idaho in 2024, but he never followed through on appointments and was disqualified, the Kootenai County Sheriff’s Office said in a news conference Tuesday.He’d also entered a Coeur d’Alene fire station in May and asked about becoming a firefighter, believing he’d be able to start that day, Kootenai County Sheriff Bob Norris said.When told there was a process, including tests and interviews, Roley became frustrated, and “it was described to us as he left there in a very, very frustrated and agitated state,” Norris said.A handwritten letter was found in Roley’s truck addressed to his father, Norris said at Tuesday’s news conference. Joe Schmidt, the company’s operations director, had spent 39 years with the company and Tom Gordon, its grocery supervisor, had been with Market Basket for 50 years. Both began working at Market Basket as teenagers.We’re expecting to hear from them around 10:30 a.m., and you’ll be able to watch the press conference live in the video player above.The Market Basket Board of Directors claimed Wednesday that the two senior executives have been making false public statements about their recent firing, saying in a statement that Schmidt and Gordon were terminated for “insubordination, making false and derogatory remarks about the company and people associated with it, and inappropriate communications with colleagues.”The Board went on to say that the pair was originally suspended with pay on May 28 following allegations that they were encouraging a widespread work disruption that would have echoed the employee walkout and vendor and customer boycott in 2014 that cost the company over a half billion dollars.According to the Board’s statement, their recent investigation yielded evidence that Schmidt and Gordon were planning a work disruption to show support for suspended CEO Arthur T. Demoulas, including instances of allegedly directly encouraging employees to slow down and disrupt operations, and to defy their supervisors. They allegedly ignored warnings to stop pressuring Market Basket associates and visited stores in Rochester and Salem, New Hampshire, despite instructions to stay off Market Basket premises during the investigation, the Board said.The Board alleges that Gordon and Schmidt have spent weeks “waging an unauthorized media campaign disparaging Market Basket and its Board, through multiple interviews” in which they both made “numerous false statements about the company and its’ leadership.”One example the Board included in its statement Wednesday was a comment by Gordon this month to NBC10 Boston about a longtime district supervisor’s suspension: “It’s a shame that this great company is being tossed into this turmoil over what seems like a succession plan.”The two former executives have denied any plans for a work stoppage, and have been outspoken about how they believed this was a succession plan by Artie T’s relatives. The Board concluded its statement Wednesday by saying Gordon and Schmidt had to know that their behavior would lead to this result. Gordon and Schmidt did previously tell the Boston Business Journal that they expected to be fired.Artie T. called their firings “heartless” and “unwarranted,” saying Schmidt and Gordon “are just collateral damage in this pre-planned coup.”“In addition to being men of strong character, these are two of the brightest and best grocery store operators in the business, and their extraordinary work has been key to building this company and its culture,” Artie T. said in a statement. “This is among the worst decisions that could be made by this board.”“Steven Collins of Exeter Capital doesn’t understand this company’s culture. Nor do his fellow board members Jay Hachigian of Gunderson Dettmer and Michael Keyes of Intercontinental Real Estate,” he added. “To them, Tom, after 50 years with the company, and Joe after 39 years, are easily cast aside. The situation is not expected to get any better anytime soonEarlier this month, defendants held for at least seven days without representation in Suffolk and Middlesex Counties were ordered released.Meanwhile, the courts said if out-of-custody defendants still don’t have representation within 45 days, charges must be dismissed without prejudice. Tuesday was just the first wave of these 45-day hearings.
